402 Permit

A Permit Issued Under the National Pollutant Discharge Elimination System (NPDES) established under Section 402 of the federal Clean Water Act (CWA). The New York program is identified as the State Pollutant Discharge Elimination System (SPDES) and is recognized as meeting the requirements of Section 402. The State Board on Electric Generation Siting and the Environment established under Article VIII was authorized to issue 402 permits for Article VIII facilities.
