The guidance provided in chapter 4: carrying out risk assessments on the review of recommendations resulting from risk assessments and the implementation of an action plan is equally applicable to assessments made under the COSHH Regulations. Some recommendations could relate to the ongoing maintenance of effective control measures and many of these aspects are covered by further specific requirements of the COSHH Regulations.
Regulation 8 of the COSHH Regulations places duties on both employers and employees in respect of the proper use of control measures, including PPE.
Every employer who provides any control measure, other thing or facility in accordance with these Regulations shall take all reasonable steps to ensure that it is properly used or applied as the case may be.
Every employee shall make full and proper use of any control measure, other thing or facility provided in accordance with these Regulations and, where relevant shall
take all reasonable steps to ensure it is returned after use to any accommodation provided for it; and
if he discovers any defect therein, report it forthwith to his employer.
As far as the employer is concerned, this should form part of the monitoring stage in the management cycle described in chapter 8: implementation of precautions. Aspects where monitoring is likely to be particularly relevant are:
correct use of LEV equipment;
compliance with specified systems of work;
compliance with PPE requirements;
